Fieldset container cannot be place on a tab panel

I can't seem to place a field set container on a tab in a tab panel. It wants to remain visible all the time.

Sorry, just noticed a January post about this and the response. I was surprised that the fieldset was different than the other "container" widgets in the "Containers" category, because the others seem to work fine.
